These Terms of Service ("Terms") govern your use of PHPVibe, a video sharing platform provided by Marius Patrascu and the PHPVibe team ("PHPVibe.com", "we", "us", or "our"). By accesing, downloading or using PHPVibe, you agree to these Terms.1. Your Acceptance
By using PHPVibe, you agree to be bound by these Terms, whether you are a visitor or a registered user. If you do not agree to these Terms, you may not use PHPVibe.NO WARRANTIES!You accept PHPVibe and its software product license "as is," and PHPVibe.com (and its third-party suppliers and licensors) make no warranty as to its use, performance, or otherwise. To the maximum extent permitted by applicable law, PHPVibe.com (and its third-party suppliers and licensors) disclaim all other representations, warranties, and conditions, express, implied, statutory, or otherwise, including, but not limited to, implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. The entire risk arising out of use or performance of PHPVibe remains with you.Limitation of Liability:
This limitation of liability is to the maximum extent permitted by applicable law. In no event shall PHPVibe.com (or its third-party suppliers and licensors) be liable for any costs of substitute products or services, or for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, or loss of business information) arising out of this T.O.S. or the use of or inability to use the software product or the failure to provide support services, even if PHPVibe.com has been advised of the possibility of such damages. In any case, PHPVibe.com's (and its third-party suppliers' and licensors') entire liability arising out of this T.O.S. shall be limited to the greater of the amount actually paid by you for the software product or U.S. $5.00; provided, however, that if you have entered into a support services agreement, PHPVibe.com's entire liability regarding support services shall be governed by the terms of that agreement.
2. Use of PHPVibe
You agree to use PHPVibe only for lawful purposes and in accordance with these Terms. You are responsible for all content you post or upload to PHPVibe, and you agree not to post any content that is unlawful, defamatory, or infringes on any third party's rights. We reserve the right to collaborate with authorities in cases of unlawful use and to provide data to investigators as required by law.3. User Accounts
To access certain features of PHPVibe, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.4. Intellectual Property
All original content on PHPVibe, including but not limited to text, graphics, logos, and videos, is owned by us or our licensors and is protected by the copyright agreement provided with each copy of PHPVibe.5. Limitation of Liability
We are not liable for any damages arising out of your use of PHPVibe or your inability to use PHPVibe. In no event shall we be liable for any indirect, consequential, or incidental damages, even if we have been advised of the possibility of such damages.6. Termination
We reserve the right to terminate or suspend your access to PHPVibe at any time, with or without cause, and without prior notice.7. Changes to Terms
We may modify these Terms at any time, in our sole discretion. By continuing to use PHPVibe after we post any such changes, you accept the Terms as modified.8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Dolj, Romania, without regard to its conflict of law principles.9. Individual licensing
The software contains third-party software components, each with individual licensing terms. You are bound by the licensing terms of each component used within the CMS.10. Cookies and data sharing
